These terms explain the agreement between you and Put A Crab On It LLC (“we,” “us,” or “our”) when you use our website design, branding, and workshop services.
In simple terms: We want to do great work for you, get paid fairly, and make sure we both understand what to expect. These terms help make that happen.
1. Services We Provide
Website Design Services
- 1-Week Website Package: Professional website completed in one week
- Full Business Package: Comprehensive website with additional features
- Ongoing support: As specified in your service agreement
Branding Services
- Logo Only: Professional logo design with files
- Complete Brand Look: Logo plus supporting brand materials
- Full Professional Package: Complete brand identity system
Workshop Services
- Public workshops: Open registration workshops
- Private hosting: Custom workshops for organizations
- Educational content: Training and support materials
2. How We Work Together
Getting Started
- Free consultation: We discuss your project and needs
- Proposal and agreement: We send you a clear proposal with scope and pricing
- Payment and kickoff: Project begins after initial payment
- Collaboration: We work together through the process
- Delivery and support: We deliver your project plus agreed support
Your Responsibilities
- Provide content: Text, images, and information we need for your project
- Timely feedback: Respond to our requests within agreed timeframes
- Payment: Pay invoices according to the payment schedule
- Communication: Keep us informed of any changes or concerns
Our Responsibilities
- Quality work: Deliver professional results that meet agreed specifications
- Clear communication: Keep you informed throughout the project
- Timely delivery: Complete work according to agreed timeline
- Support: Provide agreed support after project completion
3. Pricing and Payment
Payment Terms
- Website projects: 50% due at project start, 50% due at completion
- Branding projects: 50% due at project start, 50% due at completion
- Workshops: Payment due according to workshop agreement
- Late payments: 1.5% monthly fee on overdue balances after 30 days
What’s Included
- All services clearly outlined in your project proposal
- Agreed number of revision rounds
- Final files in specified formats
- Support period as defined in your agreement
Additional Work
- Changes beyond agreed scope will be quoted separately
- Additional revisions beyond included rounds: $150/hour
- Rush delivery (if possible): 50% premium on project fee
4. Project Timeline and Revisions
Timeline
- Website projects: Typically completed in 1-2 weeks from start
- Branding projects: Typically completed in 2-3 weeks from start
- Workshops: Scheduled according to mutual agreement
Revisions
- Each project includes specified number of revision rounds
- Revisions should be comprehensive (all feedback at once)
- Major scope changes may require additional time and cost
- Timeline extends if we’re waiting for your feedback or materials
Project Delays
- Our fault: We’ll work to catch up at no extra cost
- External factors: Timeline adjusts accordingly
- Your requested delays: We’ll work with you to reschedule
5. Intellectual Property and Ownership
What You Own
- Final delivered work: You own the completed website, logo, or materials we create for you
- Your content: You retain ownership of all content you provide to us
- Licensed elements: Some stock photos or fonts may have separate licensing terms
What We Keep
- Process and methods: Our design process and business methods remain ours
- Portfolio rights: We can show your project in our portfolio and marketing
- General knowledge: Skills and general knowledge gained remain ours
Before Final Payment
- We retain rights to work until final payment is received
- You receive full ownership upon final payment
- We can use work-in-progress for our portfolio with your permission
6. Website-Specific Terms
Hosting
- We don’t provide hosting - you’ll need your own hosting account
- We can recommend hosting providers
- You’re responsible for maintaining hosting and domain registration
Website Maintenance
- Basic updates during support period are included
- Ongoing maintenance available separately
- You’re responsible for content updates after project completion
- We’re not responsible for issues caused by third-party plugins or hosting
Browser Compatibility
- We ensure websites work properly on current versions of major browsers
- We test on Chrome, Firefox, Safari, and Edge
- Internet Explorer compatibility not guaranteed
7. Workshop-Specific Terms
Workshop Hosting
- Minimum participants: As agreed in workshop contract
- Cancellation: 14 days notice required for cancellation
- Materials: We provide all workshop materials and handouts
- Setup: Basic A/V requirements to be provided by host venue
Workshop Attendance
- Registration required: For all public workshops
- Cancellation policy: Full refund with 48 hours notice
- Materials included: All workshop materials provided
8. Limitation of Liability
What We’re Responsible For
- Delivering work that meets the agreed specifications
- Professional quality appropriate to the project scope
- Meeting agreed deadlines (barring circumstances beyond our control)
What We’re Not Responsible For
- Results of your business: We create tools; your success depends on many factors
- Third-party issues: Problems with hosting, plugins, or other services we don’t control
- Content accuracy: You’re responsible for accuracy of content you provide
- Legal compliance: You’re responsible for ensuring your content meets legal requirements
Liability Limits
- Our liability is limited to the amount you paid for services
- We’re not liable for indirect damages or lost profits
- We maintain professional liability insurance for covered services
9. Cancellation and Refunds
You Cancel
- Before work begins: Full refund minus any completed consultation time
- After work begins: Refund based on work completed, minimum 50% of project fee
- Near completion: No refund if project is substantially complete
We Cancel
- Full refund: If we need to cancel for any reason
- Work transfer: We’ll provide all completed work
- Recommendation: We’ll help you find another provider if possible
Workshop Cancellations
- Public workshops: Full refund with 48 hours notice
- Private workshops: Cancellation terms specified in workshop agreement
10. Communication and Support
During Projects
- Primary contact: Email is our primary communication method
- Response time: We respond to emails within 1 business day
- Project updates: Regular updates provided throughout project
After Project Completion
- Support period: As specified in your project agreement
- Support scope: Minor adjustments and questions about delivered work
- Additional support: Available at hourly rate after support period
11. Dispute Resolution
Our Approach
We prefer to resolve any issues through direct communication. Most problems can be solved with a conversation.
Formal Process
- Direct discussion: Contact us directly about any concerns
- Written notice: Put concerns in writing if discussion doesn’t resolve issues
- Mediation: Use mediation if needed before legal action
- Governing law: Maryland state law governs these terms
12. General Terms
Changes to These Terms
- We may update these terms occasionally
- Changes will be posted on our website with updated date
- Continued use of our services means you accept updated terms
Entire Agreement
- These terms, along with your specific project proposal, make up our full agreement
- Project proposals take precedence over these general terms for specific projects
Severability
- If any part of these terms is unenforceable, the rest remains in effect
Business Changes
- If we sell our business, these terms transfer to the new owner
- We’ll notify you of any ownership changes
